By downloading, installing, or using any Atlas Peak Media, LLC ("we," "our," or "us") application or visiting atlaspeakmedia.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

Description of Services

Atlas Peak Media, LLC develops and distributes iOS applications and web services. Our current products include:

• ✦Lexica — a premium iOS vocabulary learning application using spaced repetition to help users build vocabulary across 23 languages.
• ✦Rigor — an iOS health and fitness tracking application covering fasting, strength training, nutrition, sleep, and mobility.
• ✦Talos — an iOS and iPad real estate valuation and analysis application.
• ✦First Generation Finance — a web and iOS platform providing financial education tools and content.
• ✦Shortlist — an iOS college admissions data platform providing rankings, school comparisons, and admissions insights.

Age Requirements

You must meet the following age requirements to use our services:

• ✦Rigor: You must be at least 17 years of age to use Rigor. The app provides fasting, nutrition, and fitness tracking tools that are intended for adult users.
• ✦All other apps: You must be at least 13 years of age, or the minimum age required in your jurisdiction, to use our other services.

Medical Disclaimer

Rigor provides fasting, nutrition, sleep, and fitness tracking tools for informational purposes only. The content, features, and data presented within the app do not constitute medical advice, diagnosis, or treatment.

• ✦Always consult a qualified healthcare provider before starting any fasting, diet, or exercise program.
• ✦Do not disregard professional medical advice or delay seeking it because of information provided by our applications.
• ✦If you experience any adverse health effects while using the app, stop immediately and consult a medical professional.

Financial and Investment Disclaimer

• ✦Talos provides real estate valuation estimates for informational purposes only. Talos is not a licensed appraisal service and its estimates do not constitute financial, investment, or appraisal advice. Consult a qualified real estate appraiser, financial advisor, or other professional before making any investment or purchase decisions based on property valuations.
• ✦First Generation Finance provides financial literacy content for educational purposes only. Nothing in the app or website constitutes personalized financial, tax, or investment advice. Consult a qualified financial advisor regarding your specific situation.

Educational Disclaimer

Shortlist provides college admissions data, rankings, and institutional comparisons for informational purposes only. Rankings reflect publicly available federal data and do not represent endorsements or guarantees of admission to any institution. Admissions decisions are made solely by individual institutions. Consult directly with schools and qualified admissions counselors for guidance specific to your situation.

Purchases and Subscriptions

Some features within our applications require purchases or subscriptions, processed through Apple's App Store.

• ✦Lexica Premium — $9.99 one-time. A non-consumable purchase granting lifetime access to all premium features and all 23 languages.
• ✦Rigor Pro — available as a monthly subscription, annual subscription, or lifetime one-time purchase. Subscription pricing and terms are displayed in the app at the time of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• ✦Managing subscriptions. You can manage or cancel subscriptions at any time through your device's Settings → Apple ID → Subscriptions.
• ✦Refund policy. All purchases are processed and governed by Apple's App Store refund policy. To request a refund, visit reportaproblem.apple.com.

License and Intellectual Property

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use our applications for your personal, non-commercial purposes.

• ✦All content, design, code, and data in our applications are owned by Atlas Peak Media, LLC or licensed to us.
• ✦You may not copy, modify, distribute, sell, or reverse-engineer any part of our applications.
• ✦Your personal data (vocabulary progress, workout logs, nutrition entries, saved schools, financial records) remains yours. We do not claim ownership over user-generated content.

Acceptable Use

You agree not to:

• ✦Use our services for any unlawful purpose
• ✦Attempt to circumvent or bypass any purchase verification or licensing mechanism
• ✦Scrape, extract, or systematically download data or content from our applications
• ✦Interfere with or disrupt the integrity or performance of our services
• ✦Misrepresent data from Shortlist or Talos as official appraisals, certified rankings, or professional assessments

Disclaimer of Warranties

Our services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our services will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranty regarding the accuracy or completeness of any content, including vocabulary data, health metrics, property valuations, financial information, or admissions statistics.

Limitation of Liability

To the maximum extent permitted by applicable law, Atlas Peak Media, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services, including but not limited to damages arising from health decisions made using Rigor, investment decisions made using Talos or First Generation Finance, or admissions decisions made using Shortlist. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

Third-Party Services

Our applications may integrate with third-party services including:

• ✦Apple services: App Store, StoreKit, CloudKit, HealthKit, and AVSpeechSynthesizer
• ✦Supabase: Cloud database for First Generation Finance accounts
• ✦Federal data sources: Shortlist uses publicly available data from the U.S. Department of Education, IPEDS, and College Scorecard

Use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the content or practices of any third-party services.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date on this page. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.

Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts of Virginia.
